Westfield, Vt., man charged after boom lift operator trapped at construction site, Vermont State Police say
Vermont State Police said Ryan Bathalon, 40, was arraigned on charges including unlawful restraint and unlawful trespass after a worker was stranded in an elevated lift basket in Westfield. He is presumed innocent.
A 40-year-old Westfield, Vt., man has been charged with unlawful restraint, unlawful trespass and violating conditions of release after a construction worker was briefly trapped in an elevated boom lift basket, the Vermont State Police said in a news release issued Monday.
Troopers said they received a report at about 11:10 a.m. Aug. 20 from a construction site on Vermont Route 100 in Westfield that someone had disabled a boom lift in use, stranding the operator in the raised basket. Other workers and the operator were able to re-engage the lift after several minutes and free the operator, according to the release.
State police identified the suspect as Ryan Bathalon, 40, of Westfield, and said he had left the scene before law enforcement arrived. Troopers said Bathalon was subject to court-ordered conditions of release barring him from contacting or harassing the lift operator.
At about 2:15 p.m. Aug. 20, the Troy, Lowell and Jay fire departments responded to a structure fire at a sugarhouse on Carter Road in Troy, Vt., the release said. State police said the property owner reported that Bathalon, who had previously been trespassed from the property, was seen on video at the property before the fire. That fire remains under investigation by the state police Fire and Explosion Investigation Unit, according to the release.
Bathalon was located and taken into custody in Westfield later Aug. 20, processed at the Derby barracks and held on $2,500 bail at Northern State Correctional Facility, state police said. He was arraigned Aug. 21 in Orleans Criminal Court.
The charges are allegations, and Bathalon is presumed innocent unless and until proven guilty.
