Newtown attorney sentenced to 10 months for failing to file tax returns

Michael Simes, 51, was ordered to pay more than $2.8 million in restitution after pleading guilty to three counts of failing to file a tax return, federal prosecutors said.

A Newtown lawyer was sentenced Monday to 10 months in prison for failing to file tax returns and failing to pay more than $3.1 million in taxes, penalties and interest, federal prosecutors said.

Michael Simes, 51, was sentenced in Bridgeport by U.S. District Judge Stefan R. Underhill, who also ordered a year of supervised release, according to the U.S. attorney's office for Connecticut.

Prosecutors said that for the 2013 tax year and for 2016 through 2022, Simes, an attorney, did not file personal income tax returns, costing the IRS $1,876,307 on gross income of more than $5.6 million. For the 2016 through 2020 tax years, he asked for filing extensions until October of each year but still did not file or pay what he owed, prosecutors said.

Simes also filed returns for 2012, 2014 and 2015 but paid only a fraction of the taxes he reported as due, running up substantial penalties and interest, the office said.

He was ordered to pay $2,871,676 in restitution, the amount prosecutors said remains outstanding.

Simes pleaded guilty on March 9 to three counts of failure to file a tax return. He was released on a $40,000 bond and must report to prison on Jan. 20, 2027, prosecutors said.
