Lynn man charged with using hidden earpiece to cheat on commercial learner's permit exam

Federal prosecutors say Rudy Nolasco, 42, had a co-conspirator feed him answers through a Bluetooth earpiece during a 2021 Massachusetts commercial permit test he had previously failed.

A Lynn man has been charged in federal court with cheating his way to a Massachusetts commercial learner's permit by having a co-conspirator feed him exam answers through a hidden Bluetooth earpiece, the U.S. attorney's office in Boston said.

Rudy Nolasco, 42, is charged with fraudulently producing an identification document. He made an initial appearance in federal court in Boston on Oct. 13 and was released on conditions, prosecutors said.

According to charging documents, Nolasco arranged in November 2021 to sneak a Bluetooth earpiece into his commercial learner's permit exam so that the co-conspirator, Frank Castro, could give him the answers. Prosecutors said Nolasco had previously taken the exam and failed.

Prosecutors also said Nolasco later met with an undercover agent who was wearing a recording device and explained the scheme, including how to pay Castro and how the agent could use a Bluetooth device to cheat on the exam.

Castro was convicted of similar charges after a jury trial in January and was sentenced in May to time served, which prosecutors said amounted to about 23 months in prison.

The charge against Nolasco carries a maximum sentence of 15 years in prison.

The charges are allegations, and Nolasco is presumed innocent unless and until proven guilty in court.
