Derby man charged with third DUI after reports of impaired motorcyclist in Orleans

Vermont State Police said Burton Jacobs Jr., 29, was riding a motorcycle at an Orleans convenience store on Oct. 12 with a criminally suspended license and in violation of court-ordered release conditions.

A Derby man has been charged with driving under the influence for a third time after people reported seeing an apparently impaired motorcyclist at a convenience store in Orleans, Vermont State Police said Friday.

Burton Jacobs Jr., 29, also faces charges of driving with a criminally suspended license and violating his conditions of release, according to police.

Troopers from the state police barracks in Derby received several reports at about 10 a.m. on Oct. 12 of a man who appeared to be impaired while riding a motorcycle at the Maplefields store in Orleans, police said.

Troopers went to the store and spoke to the man, who was identified as Jacobs. Police said troopers noticed several signs of impairment. They also found that his license was criminally suspended and that he was violating conditions of release set by a court, according to the release.

Jacobs was arrested and taken to the Derby barracks. He was then held at Northern State Correctional Facility for lack of $5,000 bail, police said.

He was scheduled to appear Oct. 13 in Orleans Superior Court. Police did not say whether he entered a plea.

The charges are allegations, and Jacobs is presumed innocent unless proven guilty in court.
